2G scam: Kanimozhi, Sharad Kumar sent to Tihar jail
DMK MP Kanimozhi and her close aide Kalaignar TV chief Sharad Kumar, named as co-conspirators in the multimillion-rupee 2G spectrum case, were Friday sent to Tihar jail after a special Central Bureau of Investigation (CBI) court here dismissed their bail pleas.Addressing a packed courtroom, CBI Special Judge O.P. Saini said: “Both the bail applications (of Kanimozhi and Sharad Kumar) are dismissed. They should be taken into into custody immediately.” “Considering the magnitude of the crime, nature and enormity of the allegation, character of evidence on record and the apprehension that the witnesses may be influenced in case the accused are released on bail, I have no hesitation in holding that both accused have failed to make out prima facie case for bail. Bail applications are without merit and the same are dismissed,” the judge said. Kanimozhi, 43, who was accompanied in court by her husband Aravindan and was wearing an orange salwar-kurta, tried to regain her composure after the judgment was pronounced and later told her supporters “I was expecting the decision”. There was shock as the ruling was read out and it became apparent that Kanimozhi, the daughter of DMK chief M. Karunanidhi, would be going to jail. Many people broke into tears. Her colleagues in the DMK and security guards held each other tearfully as she was taken into the lock-up in the Patiala House court premises. Co-accused — and former communications minister — A. Raja also looked stunned. The DMK MP is already in jail in connection with the case, related to irregularities in the allocation of airwaves to telecom companies that caused huge losses to the exchequer. The court allowed Kanimozhi to carry her medicines, books and reading glasses to Tihar Jail. It even allowed her home food, but declined her plea to continue wearing her nose pin while in jail. The court rejected the submission of her counsel that she be granted bail because she is a woman. The CBI had named Kanimozhi and Sharad Kumar as co-conspirators in its April 25 supplementary charge sheet after it traced an illegal money trail of Rs.214 crore in the scam. “The allegations in the instant case are that parties were in conspiracy with each other and in the conspiracy, each party is considered agent of the other and one cannot perform his act or role without the support from other,” said the court. Also present in the courtroom Friday were former telecom secretary Siddharth Behura, Swan Telecom promoter Shahid Balwa, Raja’s aide R.K. Chandolia, Vinod Goenka of Swan Telecom and Sanjay Chandra of Unitech. Two officials of ADAG, Gautam Doshi and Hari Nair, who were also named in the charge sheet, were also present in the courtroom. Cineyug Film’s Karim Morani was not present as he got exemption from personal appearance due to his ill health, while Surendra Pipara of Reliance, who is in judicial custody, was also not present in the court as he is undergoing treatment for a heart problem at the All India Institute of Medical Sciences (AIIMS). Kalaignar TV channel had earlier stated that the Rs.214 crore it got was a loan and paid back with interest.
Karunanidhi meets Kanimozhi, Raja, Sharad Kumar in Tihar
DMK chief M. Karunanidhi Monday met his daughter and Rajya Sabha member Kanimozhi, former telecom minister A. Raja and the family-run Kalaingar TV’s managing director Sharad Kumar at the high-security Tihar Jail where the trio are lodged in connection with the 2G spectrum scam. The DMK chief, who was in the national capital on a “personal visit”, reached the jail premises at 5.43 p.m. and left in an hour at around 6.45 p.m. Director General (Prisons) Neeraj Kumar later told reporters that Karunanidhi entered the jail through the administrative block as he enjoys Z-plus security. He also said that a special request had been made that as the DMK leader was old and wheel-chair bound a place should be arranged where he could easily visit the three accused. All the three accused have been lodged in three different jails within the Tihar complex. “He was allotted a deputy superintendent’s room in jail number 6. It was selected because it was on the ground floor,” Kumar said. Karunanidhi first met his daughter and then Raja and Sharad Kumar. “While the family met Kanimozhi, the DMK leader met the two others alone,” he added. Karunanidhi was escorted by DMK parliamentary party chief T.R. Baalu and Kanimozhi’s husband G.Aravinthan. Rajathi Ammal – Kanimozhi’s mother and Karunanidhi’s third wife – was also accompanied the leader to the prison. The DMK chief, who came in black Mercedes, was accompanied by seven security cars. DMK leader Durai Murugan and K. Ponmudi were also present. DMK MP K.P. Ramalingam said: “It is purely a family visit and not a political one. That is why he never met any top UPA (United Progressive Alliance) leaders,” he told reporters later. “We will extend our moral support to her (Kanimozhi). We will camp in Delhi — go to the court and come to the jail,” Ramalingam added. From the jail, Karunanidhi directly left for the domestic section of the Indira Gandhi International Airport. “He has to catch a 8 p.m. flight for Chennai,” the DMK leader said. “Tomorrow (Tuesday) M.K. Stalin (Karunanidhi’s son and Kanimozhi’s half brother) will come to meet her (in the jail),” Ramalingam added. Kanimozhi, who was sent to jail by a Central Bureau of Investigation (CBI) special court Friday after her bail petition was denied, filed an appeal in the Delhi High Court Monday. It will come up for hearing Tuesday. “The arrest (of Kanimozhi) is a vendetta against DMK and my family,” Karunanidhi had said in an open letter to party cadres in the DMK official journal Friday. In an apparent expression of the DMK’s disappointment over the arrest of Kanimozhi, none of the six ministers of the party attended the second anniversary function of the UPA-II government here Sunday. The DMK was represented only by former minister T.R. Baalu.
